Gwyn Quillen was lead counsel for KPMG in federal and state class actions brought by investors in securities of Countrywide Financial Corp. Their claim: that Countrywide made misleading statements regarding its underwriting practices and accounted improperly for mortgage-related assets and liabilities. The case is still being litigated. She also is representing a global accounting firm in an FDIC investigation and threatened litigation relating to a failed bank, but declined to give details, as the case is still unresolved. Quillen also has represented accounting fi rms in several trials. She also has successfully defended securities fraud cases, as well as auditing, tax and consulting malpractice cases, and investigations by the Securities and Exchange Commission and the Department of Justice. Quillen predicts “a ramping up” of FDIC investigations of banks that have been taken over, with hiring and offi ces being opened up to conduct probes of bank failures. “I represent accounting firms, which are often the subject of investigations,” she said. “Some of them will result in litigation.”
