Protecting Your Solo or Small Firm Against Discrimination Claims—What Every Practitioner Needs to Know

WLALA’s Solo and Small Firm Committee proudly invites you to attend its Elimination of Bias MCLE event/dinner at Buddha’s Belly on November 17, 2010, from 6:00 p.m. to 8:00 p.m. A fabulous dinner will be served, and the event will feature an amazing lawyer and speaker, Carla Barboza, a specialist in civil rights, employment discrimination, harassment, retaliation/whistleblower claims, and wage and hour claims. There will be a no host bar, and dinner will be served promptly at 6:00 p.m. Following Ms. Barboza’s presentation, there will be a short question and answer period. After the event concludes, we encourage you to enter the main restaurant, which has a full bar, and mingle with the other extraordinary women lawyer attendees. We also encourage you to join WLALA if you have not already done so. Solo and Small Firm Membership is only $40 per year!   
In addition to getting your elimination of bias MCLE credit, this program is very important as Ms. Barboza will demonstrate why it is that we as solo and small firms need to think about discrimination claims before we find ourselves dealing with a claim and not having a plan or procedure in place to respond to such a claim. A solo or small firm is not immune to discrimination claims, but solo or small firms often have less resources than larger firms to deal with such claims. Larger firms will often have an employment law department or other related legal department that that can be utilized to help defend against discrimination claims, but solos and small firms are usually at a loss when a claim is filed and they find themselves having to invest unnecessary resources and time trying to get up to speed on the appropriate way to respond. Ms. Barboza will demystify the process for you.
In addition to providing you with all the tools and information you will need to know about protecting your solo or small firm against discrimination claims, Ms. Barboza will also discuss policies and procedures for reporting discrimination in the work place, how to respond when someone files a claim against you, the investigation process, and corrective measures that must be taken when a claim is made against you.

President’s Message

It has been an incredible month!  As you know, October was Domestic Violence Prevention Month as well as Breast Cancer Awareness Month.  WLALA was able to participate in a variety of events to increase participation in efforts to protect women on many different levels.  On October 5, 2010, I was invited by WLALA Board Member Eileen Decker to attend Mayor Villaraigosa’s Women Leaders Listening Session where an incredible room of women were assembled to discuss issues affecting women, including job corps, women owned businesses, domestic violence and the equal participation of women in sports.  Thereafter, the Mayor held a press conference regarding Domestic Violence Prevention and the incredible accomplishments of groups like WLALA and LACBA.  On   October 10, 2010, I attended the Break the Cycle Savor the Season fundraiser along with several other WLALA members as we helped raise money to break the cycle of domestic violence in teens aged 12 – 22.  We also were able to honor our member M.C. Sungaila on her service as President of  Break the Cycle’s Board of Directors.  (For more information please go to  On October 16, 2010, I attended the Mary Magdalena Project fundraiser to raise awareness and funds to assist women prostitutes to exit their lives on the street.  WLALA’s President-Elect, Tanya Forsheit, serves on the Board of Directors for this very worthy organization.  (For more information please go to  On October 28, 2010, WLALA teamed up with Dress for Success and The Suit Closet to gather donations in honor of Breast Cancer Awareness Month.  (For more information please go to and (

October also featured a WLALA West Happy Hour by the Young Lawyers Section (Sarah de Diego and Kelly Hanker); our Downtown Mentoring Circle (Jessica Pink); our monthly Networking and Mingling Lunch for Family Law and Non-Family Law Attorneys (Maria Hamar); the “Partners’ Pet Peeves” program by the Young Lawyers; and “Smart Women Arbitrate (or do they?)” program by the ADR Section (Victoria Pynchon).  Needless to say, there was something for everyone and lots of things that were for great causes. 

November promises to be just as exciting.  You will continue to receive e-mails with information about upcoming events, but you should also periodically check out the calendar at It is a snap to register for events, and once you have registered, paid the fee and put the event on your calendar, you are actually likely to go.   I can assure you that you will be  rewarded with good information and excellent networking opportunities.  We are all busy and at times feel completely overwhelmed but we all know that the way that business opportunities present themselves is multifactorial, and it is imperative to leave the office and get out there.

WLALA Holiday Reception

It is time for one of WLALA’s great traditions. This year, on December 9, 2010, from 6 to 8 pm, WLALA members will gather once again, at the beautiful City Club on Bunker Hill, to honor WLALA’s life members and recently appointed and elected members of the Judiciary. WLALA will offer free admission to all active sitting judges. Wine, hors d’oeuvres and dessert will be served.

Opening remarks will be provided by Judicial Officer and WLALA Board Member, the Honorable Jacqueline H. Nguyen who serves on the U.S. District Court for the Central District of California. Judge Nguyen was appointed by President Barack Obama in 2009. She is the nation’s first Vietnamese-American Article III judge and is an inspiration to all women lawyers and judges.
Appointed by Gov. Gray Davis to the Superior Court bench in 2002, Judge Nguyen began her judicial career at the Metropolitan courthouse in downtown Los Angeles. Later, she served at the Alhambra courthouse where she was the supervising site judge, in addition to handling a full caseload.
Judge Nguyen began her legal career as an associate in the litigation department of Musick, Peeler & Garrett in Los Angeles. From 1995 to 2002, Judge Nguyen served as an Assistant U.S. Attorney in the U.S. Attorney’s Office in Los Angeles, where she became the deputy chief of the general crimes section. She won the director’s award from the Department of Justice for her superior performance as an Assistant U.S. Attorney.

L.A. County Civil Grand Jury Seeks Applicants

The Los Angeles County Superior Court is seeking qualified individuals who are interested in applying for the Civil Grand Jury.  The Civil Grand Jury acts as a “watchdog” for all aspects of county government and conducts investigations of public

agencies.  Service on the Civil Grand Jury is an opportunity to learn how government works as well as a valuable way to contribute to the community. Recruitment is year round and applications are accepted on a continuous basis for the one year term which begins each July 1st.  From a final list of nominated persons, grand jurors are selected at random by computer. In an effort to achieve an appropriately diverse panel, the Los Angeles County Superior Court encourages women and men age 18 or older of any race, ethnicity or national origin to apply.  Do you have a family member, friend or neighbor who would make an excellent candidate? WLALA Board Member Eileen M. Decker Receives the Southwest Oral History Association’s Mink Award

In the middle, WLALA Board Member Eileen M. Decker at the Southwest Oral History Association’s Annual Awards and Grants Ceremony.  Ms. Decker received the Mink Award, the highest award honoring a significant body of oral history work, for her work on the WLALA History Project.  To the left, WLALA Immediate Past President Helen B. Please join us at the 11th Annual Buhai Brunch for a morning of good music to support the Center’s work of protecting victims of domestic violence and improving the well-being of children living in poverty. We are excited to feature a performance by Grammy nominated, reggae stars the Wailing Souls. Fusing the harmonies of Motown with the roots and dancehall sounds of reggae, the Wailing Souls have ridden the crest of Jamaica’s music scene for more than four decades.

Last year the Buhai Brunch welcomed over 300 guests for a morning of delicious Southern food, a performance by the Crenshaw High School Elite Choir, and a surprise appearance and performance by Toni Braxton. Past supporters have      included Stevie Wonder, Angelina Jolie, George Clooney, and Courtney Love. We hope you will join us!
